This user agreement is made by and between C-VIbes having registered office at C Vibes-Shop No- 12, 13, 14. GRD/ Bavdhan, Market Yard, Survey No :59/2, Pune-Mumbai-Highway, Near Sai Vilo City Phase-1, Bavadhan budruk, Pune is the owner of the brand C Vibes and the website, the C Vibes mobile application on iOS and Android devices (together referred as” Platform”) and you being subscriber to the platform with the details mentioned while creating customer profile. 

 

WHEREAS The platform provides for registration process to serve its customer better and may now or in the future collect the following personally identifiable information to serve you better: a) Name including first and last name; b) email address; c) mobile phone numbers and contact details; d) Postal Pin code; e) Personal demographic profile like your age, gender, occupation, location, address etc.,


AND WHEREAS By completing the registration or placing an order, the Customer agrees to receive promotional and transactional communication, text messages, mobile notifications, phone calls and newsletters. The Customer can opt out by contacting the customer service at cvibesmv.llp@gmail.com. We will never sell or provide your information to third party companies or outside agencies for commercial purposes. However, the platform may contain links to other web sites that we do not directly manage such as Google Analytics used to understand and optimize user’s behaviour. C Vibes shall not be responsible for the privacy policies of such external web sites.


TERMS OF USE OF PLATFORM

1. Eligibility:

• You must be at least 18 years old and capable of forming a binding contract with C Vibes to subscribe and purchase products.

• You must provide accurate, current, and complete information during the subscription process.


2. Subscription and Account:

• To purchase products from C Vibes, you must create an account and subscribe to our platform.

• You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account.


3. Terms of access to Platform:


C Vibes grants customers limited access rights for personal use on this platform and not to download (other than page caching) or edit any portion of it.


The access to this platform is for personal use of the Customer and not for any commercial use or to access its contents to collect and use of product listings, descriptions, or prices; any derivative use of this platform or any use of data mining, robots, or similar data gathering and extraction tools. No portions of this platform may be reproduced, duplicated, copied, sold, resold or otherwise exploited for any commercial purpose without express written consent of C Vibes.

Further no Customer is authorized to frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) on the platform without express written consent of C Vibes.

Any unauthorized use automatically terminates the permission granted by C Vibes.

 4. Product Orders and Payment:

• All orders are subject to product availability and acceptance by C Vibes.

• Prices for products are listed on the C Vibes platform and are subject to change without notice.

• C Vibes may impose delivery and handling fees and taxes from time to time.

• Payment must be made at the time of order placement using the payment methods accepted by C Vibes.

• By placing an order, you authorize C Vibes to charge your selected payment method for the total amount of your order, including applicable taxes and shipping fees.


5. Shipping and Delivery:

• C Vibes will make reasonable efforts to ship products to the address provided by you.

• C Vibes endeavours to fulfil orders on time, but the actual delivery time may differ from the delivery time stated at the time of placing the order. Delivery delays will be communicated by C Vibes.

• Delivery times are estimates and may vary due to factors beyond our control.

• Risk of loss and title for products pass to you upon delivery to the carrier.


6. Returns and Refunds:

• A Customer can opt to cancel order within 1 hour for the order placed either online or by calling our customer service and receive refund of advance paid if any. This is not applicable for Express delivery orders since those are processed and shipped immediately. 

• To avoid any damage claims after delivery, users are recommended to inspect the product seal before accepting the order.

• C Vibes reserves the right to cancel any order at its discretion based on product availability or if it suspects any fraudulent transaction by a customer or if customer breaches the terms & conditions of using the platform. 

• C Vibes believes in Centum Customer satisfaction and "no questions asked return and refund policy" for issues relating to quality or freshness of its supplies. 

• Customer may request for a refund/replacement within 3 Hours of delivery of the products in case of any quality issues.

• The mode of refund shall be as determined by C Vibes from time to time.

• If you receive a damaged or incorrect product, please contact C Vibes within 3 hours of delivery to request a replacement or refund.


7. Use of the C Vibes Platform:

• You agree to use the C Vibes platform for lawful purposes and in accordance with this Agreement.

• You shall not engage in any activity that disrupts or interferes with the functionality of the platform.

• To pay extra cost claimed by C Vibes in the case of redelivery due to wrong name or address or any other wrong information provided while booking order.

• To use the platform to transact for lawful purposes in compliance with all applicable laws and regulation.

• To provide authentic and true information in all instances and authorize C Vibes to validate the information provided at any point to time and reject registration if any details are found to be untrue wholly or partly.

• To access the services made available on the platform and to purchase the products offered at my own risk after using best and prudent judgement as a well-informed Customer.

• That the delivery address provided is correct and proper in all respects.

• That the product descriptions have been carefully checked before placing the order and agree to be bound by the terms and conditions of sale.


8. Obligations of Visitor / Customer:

Customer/visitor hereby unconditionally undertake not to use the Platform for:

• Disseminating any objectionable material, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or any unlawful activity.

• To transmit material that constitutes a criminal offence or results in civil liability or otherwise breaches any relevant laws, regulations or code of practice.

• To gain unauthorized access to other computer network systems.

• Interfere with any other person's right to use or enjoyment of the platform. Breach of applicable laws.

• Interfere or disrupt networks or web sites connected to the platform.

• Make, transmit or store electronic copies of materials protected by copyright without the permission of C Vibes.

• To post customer review feedback in violation of this policy or right of any third party, including copyright, trademark, privacy or other personal or proprietary right(s), and cause injury to any person or entity.

• To post comments containing libelous or otherwise unlawful, threatening, abusive or obscene material, or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any form of "spam".

• Not to use a false email address, impersonate any person or entity, or otherwise mislead as to the origin of any Customer feedback submitted on the Platform.

• To be solely responsible for the content of any Customer Feedback made and agree upon to indemnify C Vibes for all claims resulting from such Customer Feedback submitted.


9. Intellectual Property:

• All content on the C Vibes platform, including text, graphics, logos, and images, is the property of C Vibes and is protected by intellectual property laws.

• You may not reproduce, distribute, or use any content from the platform without our prior written consent.


10. Privacy:

• C Vibes collects and uses your personal information in accordance with our Privacy Policy, which is incorporated by reference into this Agreement.

• By using the platform, you consent to our collection and use of your personal information as described in the Privacy Policy.


11. Limitation of Liability:

• To the maximum extent permitted by law, C Vibes shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform or purchase of products.

• C Vibes’ total liability to you for any claims arising from your use of the platform or purchase of products shall not exceed the amount paid by you for the product in question.


12. Indemnification:

You agree to indemnify, defend, and hold harmless C Vibes and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the platform or violation of this Agreement.


13. Modifications to the Agreement:

• C Vibes reserves the right to modify this Agreement at any time. We will notify you of any changes by posting the revised Agreement on our platform.

• Your continued use of the platform following any such changes constitutes your acceptance of the new terms.


14. Governing Law:

This Agreement shall be governed by and construed in accordance with the laws of Union of India and Courts in Pune will have jurisdiction for all the disputes associated with the products of the company.


15. Dispute Resolution:

• Any disputes arising out of or related to this Agreement or your use of the platform shall be resolved through binding arbitration in accordance with the rules of Arbitration and Conciliation Act, 1996. 

• The arbitration shall take place in Pune, and the language of the arbitration shall be English.


16. Entire Agreement:

This Agreement constitutes the entire agreement between you and C Vibes. regarding your use of the platform and purchase of products and supersedes all prior and contemporaneous agreements, representations, and understandings.

By clicking the "Accept" button, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this User Agreement. You further acknowledge that your click constitutes a legal signature and execution of this Agreement, creating a binding and enforceable contract between you and C Vibes. This digital acceptance shall have the same legal effect as a physical signature.
